Your California Privacy Rights
This California Privacy Notice (“Notice”) supplements our Privacy Notice and applies to the Personal Information we may collect or have collected about users who are California residents (“you,” “your”). This Notice does not cover Personal Information we have collected from individuals in their capacity as an employee or job applicant.
A. Notice at Collection of Personal Information
Windermere collects the categories of Personal Information listed below from you, for the identified purposes and uses.

In addition to the specific purposes listed in the chart above, we may also use or disclose the Personal Information we collect for one or more of the following general purposes:
Windermere does not use or disclose does not process any of your “Sensitive Personal Information” as defined by California law, including any Sensitive Personal Information for purposes other than those specified in section 7027, subsection (m).
Windermere does not sell or share your Personal Information as those terms are defined under California law and has no actual knowledge that it sells or shares the Personal Information of consumers under the age of 16.
Windermere will retain your Personal Information as long as it is needed for the purposes described in this Notice, including to provide the services you have requested, comply with our legal obligations, resolve disputes, enforce our agreements, and achieve other purposes described under this Notice. The exact time period will vary based on the nature of the Personal Information but will not exceed legal limits.
To determine the retention period, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of Personal Information and if we can attain our objectives by other means, as well as our legal, regulatory, tax, accounting, and other applicable obligations. Once retention of your Personal Information is no longer necessary for the purposes outlined in this Notice, we will either delete or de-identify the Personal Information or, if this is not possible (which may be the case if it has been stored in backup archives), then we will securely store your Personal Information and stop processing it until deletion or de-identification is possible.

We collect your Personal Information directly from you when you contact us, complete forms on the Site, or provide Personal Information through your myWindermere account. D. Your Rights and Choices
Below are the rights you may have under California law. There are exceptions, so not all of these rights may apply to you or to Windermere’s Personal Information collection.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.
We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period. If we deny your request, we will provide reasons for the denial.
You may only make a verifiable consumer request twice within a 12-month period.
Additional Information About Your Right To Opt Out of Sale Or Sharing Of Your Personal Information
California defines the “sale” or “sharing” of Personal Information in very broad terms. We don’t sell or sell your Personal Information for monetary compensation, but some of our activities may fall within those California law definitions anyway. So, we allow you to opt out of that sale or sharing. You may do so at the following link.
The Global Privacy Control is a mechanism for you to express your preference to opt-out of the sale or sharing of your Personal Information. If we detect that you have enabled the Global Privacy Control preference signal, we will process that as a request to opt-out of the sale and sharing of your Personal Information. You should be able to activate the Global Privacy Control through your browser.
Verification of CCPA Rights Requests
We will verify your identity when you submit a request. The steps we take may vary depending on the type of request you make. We need enough detail about your request so we can understand and respond to it.
If you have an account with us, we will verify your identity by requiring you to sign in to your account.
If you request to access, correct, or delete your Personal Information and do not have an account with us, we may require you to provide certain information (such as your name and email address) to verify your identity. In addition, if you do not have an account and you ask us to provide you with specific pieces of Personal Information, we may request additional information to verify your identity.
Authorized Agents
To submit a request as an authorized agent on behalf of a consumer, please use the linked form above and include proof that the consumer has provided permission for you (the authorized agent), to submit the request. We may still require the consumer to verify their own identity directly with us.
E. Other California Privacy Rights
California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Site that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes.
